Court rejects cook's plea seeking Dhs59,000 from sponsor for withholding his passpport

Al Ain Court of First Instance rejected a lawsuit filed by a chef, in which he demanded that his sponsor pay him Dhs59,000 in compensation for the damages he suffered, claiming that the appellee refused to hand him over his passport and identity card.

He also demanded to obligate the appellee to pay fees and expenses of the lawsuit.

The appellant indicated that he used to work for the appellee as a chef, and had previously filed a labour lawsuit against him, to demand his labour dues and obligate him to return his passport and identity card.

He added that the labour court obligated the appellee to pay him some of his dues and to return his passport and identity card, but he did not, so he incurred material and moral damages, as he was unable to settle his legal status inside the country, was unable to work for any other sponsor, and had to spend a lot of money on treatments and medicines.

The court indicated that the complainant did not provide evidence that his passport was in the possession of the appellee, and that the latter refused without justification to hand it over and return it to him, especially since the appellee denied in both cases receiving the appellant’s passport.

Then, the court rejected the case and obliged the appellant to pay the fees and expenses.
