Al Ain Court obligates man to pay 20,000 Kuwaiti dinars to sister

A woman filed a lawsuit before Al Ain Court of First Instance, requesting that her brother be obligated to pay her 20,000 Kuwaiti dinars or its equivalent in UAE dirhams, Dhs240,000, 12% interest from the date of the lawsuit until payment, and Dhs50,000 in compensation for the material and moral damages she incurred, in addition to expenses and fees of the lawsuit.

In her lawsuit, the complainant indicated that she sent a bank transfer of 20,000 Kuwaiti dinars to her brother, while she was working in Kuwait, to buy a property for her, but he did not do that and took the amount for himself. The appellee confirmed that there is a partnership with his sister, affirming that he had handed over the money he received from her to another person at sister's request.

The court decided to make the complainant swear that the money transferred to her brother's account was to buy a property for her, and that she did not ask him to hand over the money to another person. In the same session, the court communicated remotely with the complainant who took the oath. The court indicated that the appellee admitted that he received the bank transfer, but affirmed that he had handed it over to another person at his sister’s request, without providing evidence of that.

The court affirmed that the appellee seized the amount unlawfully, and that the appellant suffered material damage as a result of not benefiting from the amount, so the court obligated the appellee to pay 20,000 Kuwaiti dinars to his sister or its equivalent in UAE dirhams, in addition to Dhs10,000 as compensation, besides the fees and expenses.
