Abu Dhabi Labour Court of First Instance has ordered a company to pay Dhs237,581, as compensation to an employee, who joined for work with it for about 19 years, but he was dismissed without receiving his entitlements which included end-of-service gratuity and annual leave allowance.
In the details, an employee filed a lawsuit against the company he was working for, requesting that it be ordered to pay him end-of-service gratuity for about 19 years in the amount of Dhs224,081, and annual leave allowance for a full year in the amount of Dhs13,500, in addition to fees and expenses.
The employee stated in his lawsuit that he worked for the company for several years with a basic salary of Dhs13,500, and a total of Dhs17,300, but the company dismissed him and did not fulfill his entitlements.
The court explained that a full-time employee, who has completed a year or more in continuous service, is entitled to end-of-service gratuity upon the end of his service, calculated according to the basic wage, at the rate of 21 working days' wage for each year of the first five years of service, and 30 working days' wage for each year exceeding that, and it was clear to it that the employee's service period with the company was 18 years, one month, and 11 days, and therefore he was entitled to Dhs224,081.
The court also indicated that his wage for annual leave days is calculated on the basis of the basic wage alone, and that in the absence of proof of payment, the employee was entitled to his leave allowance in the amount of Dhs13,500.
