Al Ain Civil, Commercial and Administrative Cases Court ordered a company to pay Dhs58,500, in addition to a fine of Dhs5,000, as compensation to an employee who worked for it but did not give her the monthly salaries.
The company also failed to complete the official labour contract procedures for the employee despite the issuance of the appointment notification, and the employee submitted her resignation via WhatsApp.
In detail, a female employee filed a lawsuit against a company after pursuing reconciliation, requesting the court to compel the latter to pay her overdue salaries totaling Dhs58,500, and compensation of no less than Dhs12,500, in addition to fees, expenses, and attorney's fees.
The employee stated in her lawsuit that the company offered her a position as a department head with a monthly salary of Dhs9,000, but failed to regularise her status or conclude an employment contract with her, nor did it pay her due salaries during her employment period.
The court appointed an expert who concluded that the employee worked for the company in return for an agreed monthly salary of Dhs9,000, and that she resigned from her job as indicated by a WhatsApp conversation she sent to the company apologising for her inability to continue working.
The expert also clarified that the amount due to the employee was Dhs58,500.
Regarding the request for compensation of Dhs12,500 for the damage the employee incurred due to the long delays in salary payments and the company's failure to complete the official employment contract procedures for the employee despite the issuance of the appointment notification, the court clarified that the company's representative did not appear despite being legally notified, and therefore the employee had the right to the dues she claimed.
Accordingly, the court ordered the company to pay the employee Dhs58,500 as dues and Dhs5,000 as compensation for the damage she incurred.
