The Al Ain Civil, Commercial and Administrative Cases Court ordered a company to pay Dhs466,465 to an employee after it was found that the company had delayed payment of his wages for more than two years.
Furthermore, despite the termination of their employment, the company failed to pay the employee his end-of-service gratuity or annual leave allowance.
The employee filed a lawsuit against his employer, requesting a ruling that would oblige the latter to pay him back wages totalling Dhs420,000, an end-of-service gratuity totalling Dhs24,465, a vacation allowance totalling Dhs35,000, and compensation for notice pay totalling Dhs15,000.
The employee filed a lawsuit, claiming that he had worked for the company on a basic salary of Dhs15,000. He stated that it was his last day of work and that the company had refused to pay him.
Regarding the delayed wages, the court clarified that it had been established that there was an employment relationship between the parties and that the employee had requested payment for 28 months of delayed wages.
However, he did not provide the court with a written receipt or document proving that the company had paid these wages, even though it was his responsibility to provide evidence. As his total monthly wage was Dhs15,000, he was therefore entitled to delayed wages equivalent to Dhs420,000.
