The Dubai Court of Appeal overturned a ruling issued by a court of first instance that had fined an Asian maid Dhs3,000, reducing it to Dhs1,500.
This decision was made after the maid was found guilty of being negligent in taking precautions to control the dog in her possession, resulting in the dog attacking and injuring a 14-year-old boy.
The victim's mother filed a report stating that she lives in the Emirates Hills area and that her 14-year-old son was attacked by a dog while entering the lift, resulting in an injury to his right leg. He was then taken to hospital for treatment.
The child's mother said that the dog belonged to the accused. The accused had failed to take precautions to avoid the potential danger posed by the dog, which led to it attacking the child and injuring his leg.
During the investigation, the defendant denied the allegations of negligence and failure to take the necessary precautions to prevent danger from the owner’s dog.
She stated that she had been working as a maid for her employer for three months and that, on the day of the incident, she had been with the dog in front of the lift door on the sixth floor of the building.
She explained that she was holding the leash attached to the dog and was taken by surprise when the lift door opened and the dog jumped inside and attacked the child, injuring him.
She added that she returned the dog to the apartment immediately and that she did not know why the dog had attacked the child. The court convicted her and issued the aforementioned ruling.
