Legal Advisor Dr Alaa Nasr explained that exceptional cases may arise where a travel ban conflicts with a deportation order, particularly when the individual involved is a foreigner facing deportation due to a criminal conviction, while simultaneously being subject to a court-issued travel ban related to a financial claim by a creditor.
Dr Nasr stated, in such cases, the deportation order cannot be executed while the judicial travel ban is in effect, and vice versa.
To resolve this legal issue, His Highness Sheikh Mohammed Bin Rashid Al Maktoum, Vice President, Prime Minister, and Ruler of Dubai, issued a decision to form a specialised judicial committee, tasked with examining the implementation of deportation rulings, travel ban orders, with broad powers, including postponing deportation in certain cases, cancelling judicial travel bans, and granting temporary release to individuals subject to deportation orders.
These measures aim to balance the protection of financial rights with the requirements of criminal justice and state security, ensuring fairness and legal harmony.
