9 provisions for transferring employees of federal entities to any sector in the UAE

The UAE has set 9 rules and provisions for transferring an employee from one federal entity to another or to a local entity, or to the private sector, in accordance with Article 41 of Cabinet Resolution No. 48 of 2023 regarding the executive regulations of Federal Decree-Law No. 49 of 2022 regarding Human Resources in the Federal government.

An employee may be transferred from one federal entity to another or to a local entity without prejudice to his financial entitlements, unless he agrees to that or at his request.

He may also be transferred to the private sector at his request, in accordance with the human resources procedures approved by the federal government, and in accordance with the following rules and provisions:

•The transferred employee must meet the conditions for filling the position to which he is being transferred.

•His service is considered related to the consequences of that in accordance with the provisions of the Pensions and Social Security Law.

•The transferred employee shall retain his entitlements and annual leave balances due to him from the employer from which he was transferred, if the transfer is within the federal government.

•The entity to which the employee is transferred shall bear all costs and fees that may result from the transfer, including any differences in subscription premiums, in accordance with the provisions of the Pensions and Social Security Law.

•The transfer of the employee outside the federal entity shall be subject to the approval of the entity from which he is transferred and the entity to which he is transferred.

•An employee, who suffers from an illness, may be transferred to a job that is less challenging, based on the report of the medical committee, and in accordance with the transfer rules stipulated in this decision.

•An employee may be transferred to a higher vacant position in the entity to which he is transferred, provided he fulfils the necessary conditions, in accordance with the provisions of the Human Resources Law, the Resolution and the Job Evaluation and Description System, and in accordance with the provisions of promotion.

•An employee may be transferred to any other federal entity with his job grade and financial allocations. In the event that the employee is transferred during the fiscal year, his salaries and financial allocations will continue to be paid by the entity from which he was transferred, until the end of the fiscal year, provided the budget procedures are followed in this regard.

•It is permissible to transfer any of the employees within the federal entity based on the requirements of the work interest.
