Father files case against son for withdrawing his monthly pension totalling Dhs95,400

A father filed a lawsuit against one of his sons, demanding him to pay Dhs95,400, besides the case fees and the lawyers expenses.

The father said he had given his son a proxy to run his business, and handed him over the card of his monthly pension, Dhs5,300, but he found that his son withdrew the pension amount, claiming it was suspended.

The father added when he headed to the pension authority to inquire about the reason, he discovered it was suspended 19 months after the date his son told him.

He pointed out he asked his son to return the amount but the latter did not.

The Court referred the case to investigation and listened to witnesses.

The father brought two witnesses and the first, another son, said there was an agreement between his two brothers and father that the suspect son would take the father’s bank card to run the business and hand employees their salaries but, after two months, the son said the card was not valid and the father had to pay all the expenses from his own pocket.

Later the father discovered the card was valid. The court tasked an expert, who said in his report the father pointed out that his son owed him Dhs105,600.

The father's lawyer called upon the son to pay the amount to his father, besides the fees and expenses.

The Court of First Instance obligated the son to pay the amount to his father, besides the case fees and lawyer expenses.
