The Civil Court in Dubai ordered a woman to return Dhs700,000 to an Arab national, which she seized through fraud after selling him a counterfeit watch as an original of “Patek Philippe” brand. The woman had been convicted by a final and conclusive criminal judgment and the court ordered her to pay legal interest at a rate of 5% per annum from the date of the civil judgment until full payment, in addition to fees, costs, and attorney fees.
The details of the case date back to the time when a man filed a report against a woman accusing her of deceiving him after selling him a counterfeit watch as an original of "Patek Philippe" brand, for Dhs700,000.
The appellee was referred to the Dubai Misdemeanour Court, which fined her in March 2025 Dhs10,000 for the charge attributed to her, confiscated the counterfeit watch, and ordered her to return the plaintiff Dhs700,000 which she had seized.
The defendant was not satisfied with the ruling and appealed it, but the appeal was rejected and the ruling was upheld, then she appealed to the Court of Cassation, where the appeal was also rejected, making the criminal judgment final and conclusive.
The court affirmed that it adhered to what the criminal judgment concluded regarding the proof of the appellee seizing the plaintiff's money using fraudulent methods and deceiving him about the reality of the counterfeit watch. The court also concluded that the crime for which the criminal judgment convicted her caused the plaintiff to lose his money, establishing the appellee's civil liability to compensate him for the damage he incurred.
