Al Ain Court of Civil, Commercial, and Administrative Cases rejected a lawsuit filed by a man against two, in which he demanded they pay Dhs374,000, the value of fodder he had supplied under a verbal agreement without signed contracts.
The court ruled on the case by administering a decisive oath to the appellees, which they took in its prescribed form.
In the details, a man filed a lawsuit against the two, requesting they be ordered jointly to pay him Dhs374,000, the remaining amount owed to him for fodder sales to the first appellee, which the second had guaranteed to pay.
He also requested they be ordered jointly to pay him Dhs40,000, as compensation for the material and moral damages he incurred.
The complainant stated that under a verbal agreement between him and the first appellee, he committed to supplying fodder to him at a rate of 300 bundles per day at a price of Dhs5 per piece, totaling Dhs1,500 per day for six months, and Dhs4 per piece for the other six months.
He added that he continued supplying fodder to the first appellee until the claimed amount accumulated, and the second appellee pledged to pay these amounts, but they failed to pay without any legal justification.
Based on the complainant's request, the court directed the first appellee to take the decisive oath in its prescribed form (that he did not verbally agree with the complainant to purchase fodder from him, and the complainant did not deliver any fodder to him, and that he did not owe him the amount of Dhs374,000, the value of the fodder in question).
The court also ordered the second appellee to swear that he did not verbally agree with the complainant to sell fodder to the first appellee, and that he did not pledge to pay any amounts to the complainant for the fodder sales in question, and that he did not owe the complainant the amount of Dhs374,000.
In the session scheduled for the decisive oath, the appellees appeared via audiovisual means and took the decisive oath in its prescribed form.
The court then explained that the oath settled the dispute, and therefore the complainant failed to prove his claim, so the court rejected the lawsuit.
