Man in Abu Dhabi refuses to return Dhs99,000 he received in his account by mistake

Abu Dhabi Family, Civil and Administrative Cases Court ordered a man to return another Dhs99,000, in addition to fining him Dhs20,000, after he received the amount transferred from the latter’s account by mistake, and when he realised the transfer error, he repeatedly asked him to return the amount, but he procrastinated and refused to return it.

In the details, a man filed a lawsuit against another, requesting a judgment ordering him to pay Dhs100,000, in addition to ordering him to pay Dhs30,000 as compensation for the material and moral damages he incurred as a result of the appellee’s refusal to return his money which he transferred to him by mistake, as well as ordering him to pay fees, costs, and attorney fees.

The complainant stated in his lawsuit that he mistakenly transferred Dhs99,000 from his bank account to the appellee’s account being a client of the company he owned and his account details were previously saved in his banking application. He added that when he noticed the error, he repeatedly asked him to return the amount, but he refused, which led him to initiate a criminal case and a conviction was issued as his action caused him moral and material damage. He added that it was proved that the appellee already withdrew Dhs95,000 in two installments through an ATM.

The court explained that it was established from the previously issued criminal judgment that the appellee was convicted, and thus the accusation was settled, and therefore he was liable for the amount, so the court ordered him to return Dhs99,000 to the complainant and estimated the compensation for the material and moral damages he incurred at Dhs20,000.
