Abu Dhabi court orders firm, establishment to pay Dhs360,000, for damaging cables during excavation work

Abu Dhabi Family, Civil and Administrative Cases Court ordered an establishment and a company to pay Dhs360,000 in compensation to a firm, as the establishment is owned by the company and operates in the contracting field, and while performing excavation work in an area in Abu Dhabi, its workers cut and damaged a number of fiber optic and optical cables owned by the plaintiff firm, and had pledged to bear the value of the damages and repair the harm.

In the details, a firm filed a lawsuit against an establishment and a company requesting that they be ordered jointly to pay it Dhs360,000, in addition to the legal interest of 9% annually from the date of filing the lawsuit until full payment, and to oblige them to pay fees, expenses, and attorney fees.

The plaintiff firm stated in its lawsuit that the establishment worked in the contracting field and while performing excavation work in an area in Abu Dhabi, its workers cut and damaged a number of fiber optic and optical cables owned by the complaining firm, and it had pledged to bear the value of the damages and repair the harm according to the prices shown in the compensation schedule issued by Cabinet Resolution No. 8 of 1991 and Resolution No. 17 of 2010 regarding compensation for damages to the lines, cables, and equipment of Emirates Telecommunications Corporation, and the value of the damages was estimated at Dhs360,000 according to the issued invoice.

The court appointed a specialised engineering expert who stated in his report that the establishment did not take sufficient care and caution during the excavation work, and caused through its negligence the damage of three optical fiber cables owned by the complaining firm at the work site, with a total value amounting to Dhs360,000.
