Woman ordered to repay Dhs248,052 after failing to settle loan in Al Ain

The Al Ain Civil, Commercial, and Administrative Cases Court has ordered a woman reimburse a man the sum of Dhs248,052 due to an incident involving a loan that was not entirely repaid.

The case's background indicates that the man initiated legal action against the woman, insisting she settle the outstanding debt. He claimed he had transferred Dhs317,402 to her through bank arrangements and only received a partial repayment of Dhs58,450 in return. Despite his subsequent requests for the remaining balance, she declined to fulfill her obligation, prompting the court's involvement. The ruling also involves the payment of legal interest on the unpaid sum, underscoring the serious nature of contractual financial commitments.

The judge overseeing the case selected an accounting expert from the Abu Dhabi Judicial Department's roster of approved experts. This expert determined that the defendant owed a total of Dhs248,052. There were no specific agreements or contracts between the parties stipulating terms for these amounts. The calculations relied on submitted bank transfers and WhatsApp messages.

Before making a final decision, the court required the defendant to swear a supplementary oath. During the scheduled hearing, the plaintiff attended either personally or via a representative and confirmed his readiness to take the oath, which he did in the language required. Consequently, the court concluded that the defendant was indeed liable for the amount claimed by the plaintiff and ordered her to repay it.
