Motorist must compensate owner Dhs18,000 after lane violation damages car

The Abu Dhabi Family, Civil and Administrative Cases Court has ordered a motorist to pay Dhs18,000 in compensation to the owner of a vehicle that sustained severe damage in a traffic accident caused by the driver's negligence.

According to court records, the accident occurred after the defendant failed to remain within his designated lane, resulting in a collision that caused extensive damage to the claimant's vehicle. An official traffic accident report established that the driver was responsible for the crash.

The court heard that the damaged vehicle was not covered by insurance at the time of the accident. Following the collision, the defendant attempted to have the vehicle repaired. However, repair estimates obtained by the owner exceeded the car's market value by nearly twofold, making repairs economically unfeasible and effectively rendering the vehicle a total loss.

The vehicle owner subsequently filed a civil lawsuit seeking Dhs25,000, representing the estimated market value of the damaged vehicle. He also requested legal interest of 5 per cent from the date the case was filed until full payment was made. In addition, the claimant sought Dhs5,000 in compensation for the financial and moral damages he said he had suffered as a result of the accident, along with court fees and legal expenses.

After reviewing the evidence, including the traffic accident report and documents submitted by both parties, the court ruled partially in favour of the claimant. It ordered the defendant to pay Dhs18,000 as compensation for the damaged vehicle, while also requiring him to bear the applicable legal costs in accordance with the court's judgment.
