Woman ordered to pay Dhs40,000 to a man for injuries he sustained due to her careless driving in Abu Dhabi

Abu Dhabi Family, Civil and Administrative Cases Court ordered a female driver and the vehicle's insurance company to pay Dhs40,000 in compensation to a man after the woman caused a traffic accident by colliding with his motorcycle due to failure to maintain a sufficient safety distance while he was riding it, causing him multiple injuries.

In the details, a motorcyclist filed a lawsuit against a female driver and the vehicle's insurance company, requesting that they be jointly ordered to pay him Dhs60,000 as compensation for all damages he incurred, plus a legal interest of 9% from the date of filing the lawsuit until full payment, as well as ordering them to pay the lawsuit fees, expenses, and attorney fees.

The complainant stated in his lawsuit that he was involved in a traffic accident due to the woman's error while driving her vehicle because she failed to maintain a sufficient safety distance, which led to her colliding with his motorcycle, causing him severe injuries which included a type 3 fracture of the tibial plateau bone, a bruise on the right knee, pains and injuries to the chest and abdomen, lung contusions, and scattered scratches, which required granting him sick leave for (32) days, according to what was proved by the medical report.

The complainant explained that due to insufficient insurance coverage for treatment, he was forced to travel to his home country to complete his treatment, where medical reports certified by the competent official authorities in the country proved that his condition had stabilised with a permanent disability of 30% of the function of the lower right limb, 5% skin disability, and 5% of the function of the back, in addition to his continued suffering from pain when walking and standing, difficulty climbing stairs, and the need for physical therapy.
