WhatsApp chats help lender win Dhs600,000 judgment in Al Ain loan dispute

Al Ain Civil, Commercial and Administrative Cases Court obligated a man to return Dhs500,000 and fined him Dhs100,000 as compensation to another man, who had lent him the amount as a loan on the condition that he would return it within 3 and a half months but the borrower kept delaying and refused to pay.

The court decided on the matter by reviewing the WhatsApp conversation messages exchanged between them.

Earlier, the lender filed a lawsuit against the defendant in which he requested the court to obligate him to pay Dhs500,000 plus compensation of Dhs500,000 for the serious moral and material harms he had befallen, the lost profit resulting from non-payment and his deprivation of the financial returns that he would have gained through investing the sum. The plaintiff also requested the court to obligate the defendant to pay the incurred fees and expenses.

The plaintiff pleaded that he had lent the defendant the amount claimed through a bank transfer to his bank account on the condition that the latter would return it to him after a maximum of three and a half months from the date the amount was received.

Several years elapsed but until date, the defendant had not returned the borrowed amount, not to mention that the defendant had also harmed him in various ways by refusing to pay the amount due, the plaintiff added, noting that this prompted him to file the lawsuit with the abovementioned requests.

The court decided to compensate the plaintiff for the material damage he suffered, the profits he lost and the psychological and moral harms he suffered with a total amount of Dhs100,000.
