UAE lists 5 cases where workers are not entitled to work injury compensation

There are 5 cases in which a worker is not entitled to compensation for a work injury, including the worker intentionally injuring himself for any reason, the injury occurring while the worker is under the influence of alcohol, drugs, or other psychotropic substances, the injury occurring as a result of a deliberate violation of the preventive instructions posted in the workplace, the injury occurring as a result of deliberate misconduct by the worker, and the worker refusing without a serious reason to be examined or follow the treatment prescribed by the medical authority, according to the Ministry of Human Resources and Emiratisation (MoHRE). Medical authorities must prepare a certified medical report on the worker's injury, specifying the injury, the type of occupational disease, the cause of either, its date, its relationship to work, the duration of treatment, the degree of disability, whether it is total or partial, and the extent of the injured worker's ability to continue performing the work, MoHRE explained.

The procedures for verifying work injuries, which include the competent investigation authority at the police station conducting the necessary investigation procedures according to the established procedures in this regard as soon as the report is received, MoHRE added.

An inspector from the MoHRE or from relevant authorities allegedly assists the investigation authorities in gathering evidence if necessary, and the data and information included in the investigation are considered evidence used by the medical authority, which has the final decision on whether the worker suffers from a work injury or not.

The investigation authority also provides MoHRE with a copy of the results of the procedures taken, along with a copy of the investigation record, MoHRE added.
