Dubai court orders woman to repay Dhs100,000 loan to company

Dubai Civil Court of First Instance ordered a woman to pay Dhs100,000 to a company, along with 5% legal interest from the date of the judicial claim until full payment, in addition to fees, expenses, and lawyer's fees, after it was proved that the woman had received the amount as a personal loan, documented by a written acknowledgment and a bank cheque.

The details of the case date back to the time when a company filed a lawsuit, stating that the appellee, an employee, had received a loan of Dhs100,000 in July 2017, via a cheque issued from the company's account, after she signed an acknowledgment confirming receipt of the cheque as a personal loan.

The company submitted documents to the court, including a copy of the cheque,  the acknowledgment signed by the defendant, and a bank statement proving that the cheque's value was disbursed from the company's account the day after its issuance.

The company indicated that it had repeatedly demanded payment from the appellee and sent her a warning in December 2023, but she did not respond.

During the trial, the appellee did not appear despite being legally notified.

The court, in its verdict, affirmed that the appellee signed the acknowledgment and did not appear to present her defence or deny the charges. The court also clarified that the documents contained conclusive evidence of the debt, namely the cheque, the acknowledgment signed by the appellee, and the bank statement, which proved the appellee's liability for the claimed amount.

Consequently, the court ordered the appellee to pay the full amount, with legal interest at 5% from the date of the judicial claim until full payment.
