The Civil Court in Dubai annulled a contract between an Arab man and a tourism company, and ordered the company to repay him Dhs8,200, the value of the contract concluded between the two parties, in addition to Dhs5,000 in compensation.
This verdict was issued after it was proved that the company breached its contractual obligations and failed to provide the agreed-upon services, resulting in material and moral damages to the plaintiff.
The details of the case date back to December 2025, when an Arab national filed a lawsuit demanding the annulment of the contract with the tourism company and obliging it to return Dhs9,300, which included the amount he already paid, in addition to notarisation and translation expenses, as well as compensation for moral damages, and court fees and expenses.
The appellant stated that the company breached its contractual obligations, after he contracted with the latter to purchase a tourist holiday package for Dhs8,550, after its representative convinced him that they would provide multiple tourist services, with the possibility of payment in installments without interest. However, he found that there were monthly interest, in addition to the company's failure to fulfill any of its contractual obligations despite his repeated follow-ups.
According to the case documents, the court appointed an expert, who concluded in his report that the plaintiff had paid the full contract value, and that the company had failed to fulfill its obligations, in addition to proving its closure due to legal violations. He added that the net amount due to the plaintiff was estimated at Dhs8,200.
The court indicated, based on the expert's report, which it found satisfactory, and the case documents, that the company breached its contractual obligations and failed to provide evidence of performing the agreed-upon services, which allowed the plaintiff to request the annulment of the contract, in accordance with the provisions of the Civil Transactions Law.
Accordingly, the court annulled the contract and ordered the defendant to repay the amount received from the plaintiff, in addition to compensating him with Dhs5,000, as well as fees, expenses, and attorney's fees.
