The Civil Court in Dubai ordered a company operating in luxury car passenger transport to pay Dhs40,000 to a client, along with a legal interest of 5% from the date of the claim until payment, in addition to fees, expenses, and legal costs.
In detail, a man filed a lawsuit against a company operating in luxury car passenger transport, demanding that it be compelled to return him Dhs40,000, in addition to legal interest, after he agreed with the company to purchase a 2023 Lexus car and paid Dhs40,000, divided as Dhs35,000 as a down payment, Dhs5,000 as the two installments, based on stamped invoices and receipts issued by the company.
According to the lawsuit documents, the company later recovered the car, and when asked to return the paid amounts, it refused without legal justification, which prompted the plaintiff to resort to the judiciary.
The plaintiff submitted copies of the receipt and invoices supporting his payment.
During the consideration of the case, the plaintiff appeared before the Case Management Office and requested that the case be referred to the court, while the defendant company failed to appear, including at the final pleading session.
The court indicated that the plaintiff submitted documents proving the company's liability for the claimed amount, while the latter did not present any defence or proof of payment. Based on this, the court ordered the company to repay the full amount, as well as a late payment interest of 5% annually from the date of the claim until full payment, in addition to the lawsuit fees, expenses, and legal costs.
