Abu Dhabi court obligates firm to pay Dhs231,504 in compensation to employee

Abu Dhabi Labour Court of First Instance obligated a company to pay Dhs231,504 to a former employee as compensation for her delayed monthly salaries, end-of-service bonus, annual leave entitlements and notice pay.

The employee had worked for the company for approximately six years, but the company had failed to pay her dues.

Earlier, an employee filed a lawsuit against the company she worked for in which she requested the court to obligate it to pay her back wages for a period of 6 months totaling Dhs156,000 plus Dhs40,833 as end-of-service bonus, Dhs7,000 as annual leave entitlement and Dhs51,000 as notice pay.

The plaintiff also requested the court to obligate the defendant to hand an experience certificate over to her and to pay the incurred expenses and lawyer’s fees and to include immediate enforcement of the judgment, noting that she worked for the company with a basic wage of Dhs7,000 and a total of Dhs28,000.

The court explained that as the case file did not have any evidence on the company’s exemption from the agreed-upon wage, the employee was hereby entitled to her delayed wage for this period, amounting to Dhs156,000.

Furthermore, the employee's service period was more than 6 years and hence she was entitled to Dhs17,504 accordingly, the court said, adding that the employee's service had ended and therefore her annual leave entitlements should be calculated based on her basic wage and consequently she would be entitled to Dhs7,000.

It was also established in the employment contract that the notice period agreed upon between the employee and the company was three months and therefore the court ruled that she should be given Dhs51,000 accordingly.
