Al Ain court orders minor's parent to pay other child's mother Dhs20,000

Al Ain Civil, Commercial and Administrative Cases Court ordered a parent to pay Dhs20,000 to the mother of a minor student who was assaulted by the father's minor son.

The two were schoolmates and the incident occurred when the first student kicked the bathroom door without ensuring no one was inside, causing the door to close on the victim's finger, resulting in the amputation of the tip of the little finger of the victim's left hand.

The mother filed a lawsuit requesting that the parent of the first child be ordered to pay her Dhs300,000 as comprehensive compensation for the physical, psychological, and future damages (permanent disability) incurred by her minor son, in addition to fees, expenses, and legal attorney fees.

The complainant stated in her lawsuit that her son was assaulted while in the school bathroom by the other child, who violently closed the bathroom door on him, causing him severe injury.

The plaintiff added that the perpetrator was convicted in a criminal case for causing injury to the victim due to his negligence in not taking necessary precautions, as he kicked the bathroom door without ensuring the victim was not inside, which led to the door closing on the latter's finger.

The court clarified that it was evident from the case documents and the reliable medical report that there was an amputation of the tip of the little finger of the left hand, a dislocated nail, and a fracture at the upper end of the amputation site, which constituted a permanent disability at the amputation site, although it did not invalidate the function of the finger.

Consequently, the court ordered the first child's parent to pay Dhs20,000 in compensation for the psychological and material damages incurred by the victim.
