Dubai court obligates man to pay Dhs10,000 compensation to his wife for assaulting her

A man assaulted his wife and was subsequently convicted and fined by the Criminal Court and the verdict was upheld by the Court of Appeal.

The wife then resorted to the Civil Court, where the competent court ruled that he be obligated to pay Dhs10,000 in compensation for the harms that his wife had befallen plus interest at five per cent from the date the judgment became final.

Earlier, a dispute arose between a man and his wife, which snowballed into a verbal altercation, before he threatened and assaulted her, causing her injuries.

The wife reported the incident to the police and submitted a certified forensic report, which showed that she suffered from contusions and abrasions resulting from impact and friction with hard objects and requiring 20 days to heal without causing permanent disability.

Consequently, a criminal case was filed against the husband, who was convicted and fined by the Court of First Instance and the verdict was upheld by the Court of Appeal.

The court pointed out that the incident was the subject of a criminal case, in which a judgment was issued in the presence of the defendant, who was convicted and fined, adding that the defendant appealed the verdict but the Court of Appeal accepted upheld the verdict so that it became final according to the issued certificate.

The court stated that the defendant neither appeared before it despite being notified, nor presented anything that would undermine this proof, while it was proven that the plaintiff suffered physical and moral harms due to the assault and had to pay expenses in order to claim her right.

The court concluded that the elements of tort liability were present and hereby estimated the compensation for these harms at Dhs10,000 plus legal interest at five per cent from the date the verdict became final until full payment. The defendant was also obligated to pay the incurred fees and expenses.
