The Commercial Court in Dubai ordered a company to pay a water supplier Dhs30,265, with a legal interest of 5% annually starting from the date the lawsuit was filed until full payment, in addition to obliging it to pay fees, expenses, and lawyer’s fees.
The case dates back to February 2026, when the company contracted with a water supplier to supply 5,000 gallons of water for a monthly fee. The supplier allegedly fully fulfilled his obligations, delivering the water in a truck according to the agreed-upon terms, while the company recorded operating hours through logs.
The supplier clarified that he issued monthly invoices for the amounts due, which the company received and signed, but the company only paid a part of the dues, leading to an accumulation of a financial amount. He added that despite repeated warnings and friendly demands, the company did not pay the amounts, which prompted him to file a lawsuit, attaching the purchase order, tax invoices, and account statement.
The company did not attend the sessions to present any defence despite being legally notified, and the court affirmed the completion of water supply and the authenticity of the submitted documents.
The court indicated that the concluded contract obliges both parties to fulfill their obligations, and that the plaintiff fulfilled his obligations but the defendant company did not pay dues according to the documents.
The court also found that the company's delay in paying the due amount justifies the judgment for legal interest for the period of delay.
