The Al Ain Civil, Commercial, and Administrative Cases Court has ordered a man to pay Dhs65,000 to another party in a case involving the misappropriation of a vehicle.
The car had been entrusted to him by its owner for the purpose of selling it, with an agreement to hand over the proceeds. However, the man neither returned the car nor provided any compensation to the owner.
Case records reveal that the vehicle's owner had entrusted it for sale, but the defendant misused it, resulting in his conviction in a criminal case filed by the Al Ain Public Prosecution.
After the criminal verdict, the owner pursued a civil claim, requesting compensation of Dhs45,000 for the vehicle's value and Dhs55,000 for lost profits and other damages, in addition to court fees and related costs.
The Court found that the defendant had misappropriated a vehicle entrusted to him by its owner. The vehicle was handed over to the defendant in his capacity as an agent with the responsibility to sell it and remit the proceeds, but he failed to return the vehicle or pay for it.
According to the owner, this act caused him significant damages, with the vehicle being valued at Dhs45,000. The defendant did not contest these claims and requested permission to pay the amount in installments.
Consequently, the court ruled that the defendant must compensate the owner by paying Dhs45,000 for the vehicle’s value. Additionally, the defendant was ordered to pay Dhs20,000 as further compensation.
In light of these considerations, the court concluded that a total sum of Dhs65,000 adequately covered all damages incurred by the vehicle's owner, encompassing both its value and the additional compensation awarded.
