Abu Dhabi Family, Civil and Administrative Cases Court obligated two people to pay Dhs150,000 for beating a man in the face and head and trying to choke him, causing a permanent disability to him.
The victim subsequently suffered brain injury symptoms including headaches, memory loss, insomnia, lack of concentration and nervousness, all of which were neurological complications that could occur following traumatic head injuries and constituted a permanent disability and permanent impairment estimated at about 20 per cent of its original nature.
Earlier, the plaintiff filed a lawsuit against three people in which he requested the court to obligated the defendants to jointly and severally pay him Dhs500,000 in compensation for the harms and injuries he had befallen as a result of their assault plus the incurred charges, expenses and lawyer’s fees.
The plaintiff pleaded that the defendants assaulted him physically as the first defendant punched him in the face and the second tried to choke him and joined the first in striking his face and head, while the third lifted him up and threw him to the ground, causing him to fall unconscious on his back.
The assault resulted in a permanent disability; namely, cerebral symptoms from the head injury and limited movement of the left shoulder due to a fracture of the left clavicle, which they did not intend to cause, as detailed in the investigations, he said.
The defendants also damaged his mobile phone, described and valued in the documents, during the use of violence against him, while the second defendant publicly insulted him in a manner that tarnished his reputation by uttering the words mentioned in the documents in a public place, as detailed in the investigations, he added.
The court explained that the criminal judgment issued in the previous appeal showed that it was not the first defendant but the second and third defendants who caused a permanent disability to the plaintiff.
The Criminal Court of Appeal ruled that a compensation of Dhs70,000 should be paid to the plaintiff, who did not provide the harms that he suffered and his statements were unsubstantiated.
The closed displaced fracture of the outer end of the left clavicle, coupled with the surgical intervention required constituted a permanent disability and impairment estimated at about 30 per cent of the left upper limb, it added.
Based on the above, the court estimates the total compensation due for the material and moral harms that the plaintiff suffered, which included his inability to work, physical and psychological pains, defamation, slander and insults at Dhs150,000.
