The Abu Dhabi Family, Civil and Administrative Cases Court ordered a woman to pay Dhs13,500, in addition to Dhs2,000, as compensation to another woman, from whom she had borrowed the amount in installments to establish a commercial project for selling abayas, but then refused to repay those amounts.
In detail, a woman filed a lawsuit against another, requesting that she be ordered to pay her Dhs13,500, the amounts due as a result of a financial agreement between them, and to pay her Dhs7,000 as compensation for the material and moral damages she incurred, besides the expenses and lawyer's fees.
The plaintiff stated that the defendant borrowed Dhs13,500 from her, which she transferred to her in installments to establish a commercial project for selling abayas, but she then refused to repay the amounts.
The defendant admitted that the plaintiff was her ex-husband's mother, and that the amount transferred from her was compensation for her son's assault on her, and that she did not delay in repaying the amount as the plaintiff stated, as she did not demand it for nearly two years.
The court was not provided with any evidence that she borrowed the amount.
The plaintiff requested that an oath be administered to the defendant to swear that the amount was not a loan but compensation for her son's assault on her, and also requested the dismissal of the lawsuit due to lack of validity and proof.
The court clarified that it was established that the defendant did not deny the transfer of those amounts to her, but she denied that they were a debt, claiming they were compensation for the assault committed against her by the plaintiff's son, her husband.
Meanwhile, the plaintiff insisted on the claim that the amount was a debt, and the court was not provided with evidence that this amount was compensation and not a debt.
The court then stated that the defendant was indebted for the claimed amount, and accordingly, the court ordered her to pay Dhs13,500, in addition to Dhs2,000 as compensation for all material and moral damages she incurred.
