The Al Ain Civil, Commercial, and Administrative Cases Court has ruled that an individual must pay Dhs10,800, along with an additional fine of Dhs10,000 as compensation to a woman.
This decision came after he was found guilty of deliberately damaging her vehicle by intentionally hitting it, as established in a criminal case. Consequently, the woman incurred repair costs and had to rely on a taxi to commute to work.
The plaintiff filed a lawsuit against the defendant, demanding Dhs50,000 in compensation for both material and moral damages caused by his actions. This claim also covered court fees and related legal expenses.
The woman initiated her lawsuit, claiming the accused intentionally damaged her personal vehicle by deliberately colliding with it, resulting in his conviction in a criminal case.
As a consequence of her car being out of service due to his actions, she incurred various expenses, including daily taxi fares to commute to work. Furthermore, the repair costs for the vehicle were estimated at Dhs14,000.
These circumstances led her to pursue legal action and make the stated demands.
The court determined that the defendant was at fault, and the plaintiff, the owner of the damaged vehicle, claimed to have suffered multiple losses due to the accident caused by the defendant.
These losses were represented by the damage to her vehicle. She provided three repair estimates for the vehicle's damages. Consequently, it falls within the court's discretion to evaluate and determine the appropriate compensation based on the specifics of the case.
The court concluded that an amount of Dhs10,800, corresponding to the middle estimate, would adequately compensate her solely for the damage to the vehicle.
The court determined that the accused's fault was established and led to moral harm, reflected in the complainant's psychological distress caused by his actions, as well as her inability to use the vehicle, forcing her to rely on alternative transportation.
A causal link between the fault and the resulting damage was identified, making him legally responsible for compensating her. Exercising its discretionary authority and considering the case's specifics, the court assessed the moral compensation owed to her at Dhs10,000.
