Abu Dhabi court obligates developers to pay villa buyer Dhs250,000 for repair works

Abu Dhabi Commercial Court of First Instance ordered a company to pay Dhs250,000 in compensation, to a woman who bought a villa from it, only to discover many defects and cracks which led to internal and external water leakage and recurring cracks in the walls, along with dampness and swelling of the exterior paint, due to the developer's negligence.

The woman filed her lawsuit, stating that upon a sale and purchase agreement, she discovered many defects after receiving the villa, adding that the company sent maintenance workers after being notified of the defects, but they failed to repair them, which led to the cracks appearing multiple times.

The buyer commissioned a consulting expert to investigate these defects and he concluded in his report that the property in question suffered from structural defects requiring immediate repair at a total cost of Dhs250,000. The expert also indicated that the defects violated the warranty agreed upon in the contract.

The court clarified that it was satisfied with the consulting expert's report and therefore adopted it, especially since it was supported by the documents on which it was based.

It was also proved to the court that the defects violated the warranty agreed upon in the contract between the two parties, and that the company is responsible for compensating the buyer for the cost of repairing these defects, which the expert estimated at Dhs250,000.
