Abu Dhabi Labour Court ordered a company to pay Dhs628,468, Dhs3,000 and provide a travel ticket to an employee who had been working for it for about 24 years but had not been paid his monthly salary for about five years at intermittent intervals.
In detail, the employee filed a lawsuit against the company he worked for after complaining to the Ministry of Human Resources and Emiratisation, requesting that the company be ordered to pay him 59 months of back pay totalling Dhs421,763, end-of-service gratuity of Dhs89,995, annual leave allowance of Dhs26,000, health insurance fees of Dhs107,442, and a travel ticket worth Dhs3,000.
He also requested that his certificate of experience be handed over to him, along with late payment interest of 12% from the date of the legal claim until full payment.
The employee stated that he worked for the company with a basic salary of Dhs4,000 and a total of Dhs12,500.
The court clarified that the employer must pay the wages of his employees on the due dates in accordance with the terms, conditions and procedures of the contract and in accordance with the regulations and standards set by the Ministry.
The court added that since the case documents did not indicate that the company had fulfilled its obligation to pay the agreed wages, the employee's claim was justified, and the court ruled that the company must pay Dhs421,763.
The court also stated that the employee is entitled to Dhs89,911 for his period of service and Dhs9,667 in holiday pay.
Furthermore, the documents submitted by the employee proved that he paid health insurance expenses and fines amounting to Dhs107,127.
