The Al Ain Court for Civil, Commercial and Administrative Cases has ruled that a bank must pay Dhs100,000 in compensation to a customer who obtained a personal loan of Dhs250,000 from the bank.
Despite the customer's commitment to paying back the loan and additional amounts, the bank continues to unjustly deduct sums from him.
Specifically, a client filed a lawsuit against his bank, requesting a ruling that would oblige the bank to pay him Dhs100,000.
The client also requested the appointment of a banking expert, whose duties would include investigating the elements of the lawsuit and proving the claim. The client also requested that the bank be obliged to pay the fees and expenses.
The client filed his lawsuit on the grounds that he obtained a personal loan worth Dhs250,000 from the bank. Despite his commitment to paying back the loan and any additional amounts due, the bank continues to unjustly deduct sums from him, prompting him to file the present lawsuit in the hope of obtaining a favourable judgement.
The court explained that the relationship between the two parties in the lawsuit was as follows: in response to the client's request for a commercial loan, the bank agreed to grant him a loan of Dhs300,000, divided into two parts.
Seventy per cent of the total loan amount will be paid in 186 monthly instalments of Dhs3,426, and the remaining amount will be paid in a single instalment when the final monthly instalment is paid.
The annual interest rate is 12%, and interest will be calculated on the total loan amount and paid with the monthly loan instalments. The loan amount of Dhs300,000 has been deposited with the bank and thus the client has benefited from it.
The court was satisfied with the expert's conclusion in his report and accepted it, as it was based on solid research and documentation. The documents indicated that the bank had received amounts in excess of its entitlements from the customer, without justification, and was required to return them. The total amount due was Dhs100,000 as of the date the lawsuit was filed.
