Abu Dhabi Labour Court – First Instance ordered a company to compensate an employee with an amount of Dhs197,600, as he had been working for the company since 2010, but the latter failed to pay his due monthly wages for 22 months intermittently throughout his employment period, and the company also did not provide him with an end-of-service gratuity or annual leave allowance.
In detail, an employee filed a lawsuit against the company he worked for after resorting to the Ministry of Human Resources and Emiratisation committee.
He requested the company to pay him overdue wages for 22 months totaling Dhs144,000, an end-of-service gratuity of Dhs57,000, an annual leave allowance of Dhs8,000 and court expenses.
The court indicated that it was established from the documents that the employee worked for the company since 2010 with a basic salary of Dhs4,800 and a total of Dhs6,000, and his relationship with the company ended, thus he was entitled to claim his labor dues.
The court also clarified that the case documents do not indicate the company's clearance from the employee's remaining wages for his 22-month period of employment.
Therefore, he is entitled to claim his overdue wages for this period amounting to Dhs132,600, and he is also entitled to an end-of-service gratuity of Dhs57,000.
The court also stated that the employee's salary for annual leave days is calculated based on the basic salary, and therefore he is legally entitled to receive an annual leave allowance of Dhs8,000.
