The Al Ain Civil, Commercial and Administrative Cases Court ordered an individual to collect his vehicle from an auto repair shop and pay Dhs10,000.
The man had taken his vehicle to the shop for repairs, but refused to collect it due to a dispute over repair costs.
A car repair shop filed a lawsuit against a customer (the car owner), requesting that the court order the customer to immediately collect the disputed vehicle, which has a market value of Dhs20,000, from the repair shop's headquarters.
The customer was also required to pay Dhs50 per day for each day that he delayed collecting the vehicle, from the date of the legal notice until the vehicle was actually delivered.
This would amount to approximately Dhs19,000 in total, and this amount would increase until the vehicle was collected. The customer was also required to pay additional financial compensation, estimated at Dhs10,000, for the commercial and moral damage caused to the repair shop by occupying the workshop space and preventing the repair shop from using it during that period.
The workshop filed the current lawsuit on the basis that the vehicle's owner had brought it to the workshop for repair.
As a result of a dispute over repair costs and compensation, the workshop filed a previous lawsuit, which ruled that the vehicle's owner must pay financial compensation to the workshop.
Despite the ruling being implemented, the vehicle's owner still refuses to collect the vehicle from the workshop. The vehicle remaining in the workshop for such a long period has prevented the workshop from receiving other vehicles, as the space is being used up. This prompted the workshop to file the aforementioned lawsuit.
In its ruling, the court explained that the vehicle owner was at fault for failing to collect and transport his vehicle from the workshop after learning that the repairs had ceased.
The court also found that he had failed to claim compensation for the damage caused, and had failed to take responsibility for protecting the vehicle during this period.
The court also found that there was a causal relationship between the error and the damage, and that the defendant was legally obliged to compensate the claimant for it.
Based on its discretionary authority and the circumstances and details of the case, the court estimated the compensation for damages at Dhs10,000. The claimant suffered loss and damage in this case.
