The Al Ain Civil, Commercial and Administrative Cases Court has ordered a guardian to pay Dhs30,000 in compensation to a female guardian whose son was bullied and beaten at school and at home by the defendant's children.
The child was filmed during the attack and experienced several negative consequences as a result of the defendant's children's actions, including fear, mood swings and a loss of emotional control.
Specifically, the complaining guardian filed a lawsuit against the defendant’s guardian, requesting that the court oblige the defendant, in his capacity as guardian of two children, to pay Dhs500,000 in compensation for material, psychological and moral harm caused by the defendant’s children.
This is due to the harm suffered by the complainant’s son, who is in her custody, as a result of proof of negligent liability on the part of the defendant’s children. The defendant is also required to pay fees, expenses and attorney’s fees.
The complainant filed her lawsuit on the basis that the defendant's sons had assaulted her son by bullying and beating him at school and at home, and that the beating had been filmed. The defendants were convicted in a criminal trial. As a result of the actions of the defendant's sons, her son suffered several harms, including feelings of fear, mood swings, and a loss of control over his emotions, which prompted her to file the aforementioned lawsuit.
In the grounds of its judgment, the court explained that the defendant’s sons had been proven to have made an error, which resulted in harm to the complainant’s son.
This harm is evident in the physical damage sustained by the complainant’s son, as detailed in the criminal judgment that forms the basis of the lawsuit. This damage left the complainant’s son unable to carry out his personal work for a period not exceeding twenty days, and caused him psychological pain as a result of the assault. Furthermore, the assault occurred in public view.
Based on the circumstances and details of the lawsuit, the court estimates the compensation due to the complainant at an amount of Dhs30,000, using its discretionary power.
