The Abu Dhabi Family, Civil and Administrative Cases Court ordered an individual to pay Dhs182,062 in damages and a fine of Dhs12,500.
The individual was found guilty of misappropriating and embezzling his workplace's funds, which had an adverse effect on its status as a for-profit institution. He was also found to have a previous criminal conviction.
The institution filed a lawsuit against the defendant, requesting that the court order him to pay Dhs182,062 in compensation for material and moral damages, along with fees and expenses, and a further Dhs50,000.
The court found that the defendant had embezzled the institution's funds for his own benefit by squandering and misappropriating them. As he failed to provide evidence of his innocence regarding the sum specified in the criminal judgement, the case is now considered to be based on sound factual and legal grounds. Accordingly, the court has ordered him to pay the institution Dhs182,062.
Regarding the request for material and moral compensation, it was stated that the facts and documents proved that the institution suffered financial loss as a result of the defendant’s actions. He embezzled its funds, which affected its financial value, as it is a profitable company.
Therefore, the tangible financial loss due to the imprisonment of the individual in question and the lack of benefit from him warrants material compensation of Dhs5,000.
Moral compensation is not intended to enrich the company, but rather to compensate for damage to its commercial reputation and customer confidence in the market.
This leads to indirect losses due to a decline in public confidence and a fall in its moral value among its peers, resulting from an unlawful act committed by a third party against the company.
This has caused moral damage to the legal entity, for which it deserves moral compensation of Dhs2,500. Therefore, the court awards him material and moral compensation totalling Dhs12,500.
