The Abu Dhabi Family, Civil and Administrative Cases Court ordered a guardian to pay Dhs30,000 in compensation to a person who was allegedly assaulted by the guardian's son, resulting in injuries including a 10% disability to the right lower limb.
In details, the plaintiff filed a lawsuit against the defendants — the guardian and his son — requesting that they pay him Dhs500,000 in compensation for the material and moral damages he suffered, plus legal interest at 9% per annum from the date of filing the lawsuit until full payment is made.
The Court explained that the papers and the report of the assigned expert concluded that the complainant had suffered impaired motor performance in the right lower limb due to a complete tear of the Anterior Cruciate Ligament in the right knee.
The expert estimated the disability rate at 10% of the function of the right lower limb. The complainant's injury to the right hand healed without leaving any permanent impairment or disability.
The Court stated that the previous criminal judgment issued against the two defendants had ordered them to pay the complainant Dhs21,000 in compensation.
As a result of the defendants' error, the complainant sustained the injuries described in the medical report prepared by the appointed expert.
These injuries, in addition to the losses incurred by the complainant, constituted material damage, estimated by the court at Dhs41,000.
The court also stated that the injury had caused the complainant pain and sorrow, constituting moral damage, estimated by the court at Dhs10,000.
As the court was permitted to order general compensation to cover all damages, it estimated the material and moral damages sustained by the complainant in the incident in question at Dhs51,000.
However, as Dhs21,000 had already been ordered by the aforementioned criminal judgment, the court required the guardian, in his personal capacity and as guardian of his minor son, to pay the complainant Dhs30,000 in final compensation for all material and moral damages sustained.
