The Al Ain Civil and Administrative Cases Court has ordered a woman to pay Dhs100,000 in compensation to the owner of a car she collided with due to her negligence and failure to adhere to traffic rules.
The accident resulted in a complete shoulder bone fracture, requiring surgery to stabilise it.
The victim was discharged from hospital on two months' sick leave. Due to the injury, he was absent from work, resulting in him losing his salary until his employer terminated his employment.
Specifically, the plaintiff filed a lawsuit against the defendant, requesting a ruling at the end of the proceedings that would oblige the defendant to pay the plaintiff Dhs500,000 in material and moral compensation, plus legal interest at a rate of 12% from the date the ruling becomes final until full payment is made.
The ruling would also oblige the defendant to pay the fees, expenses and attorneys' fees.
The plaintiff filed his lawsuit on the basis that the defendant collided with his car due to her own fault and failure to adhere to the general traffic rules.
She was convicted in a criminal case of causing harm to the safety of the victims' bodies, including the complainant's, through her fault.
The accident resulted in a complete fracture of the shoulder bone, requiring surgical intervention to stabilise the bone and humerus. He was discharged from hospital on two months' sick leave and, due to the injury, was unable to work, resulting in the cessation of his salary until his employer terminated his employment.
The accident also resulted in the complainant being unable to go about his daily life, as well as the aforementioned material and health damage.
This was in addition to the psychological damage caused by sadness and grief over losing his job, accumulating debts, the cessation of his children's education despite their excellence, and not having an income to cover living expenses.
The Court explained that the defendant had caused the plaintiff to sustain a contusion to the right upper limb. The functional disability resulting from this injury is estimated to be 50% of the benefit of the right upper limb.
This injury is likely to affect the plaintiff's daily activities involving the use of the right upper limb. Therefore, the defendant is at fault. The Court estimates that the plaintiff is due compensation of Dhs100,000.
