Abu Dhabi Family, Civil and Administrative Cases Court obligated a man to return Dhs500,000 to another. The defendant had deceived the victim into believing he was investing and had requested a sum of money from him on the condition that he return the sum with profit.
According to correspondence between the two, the defendant had procrastinated without justification as supported by WhatsApp conversations.
Earlier, the plaintiff filed a lawsuit against the defendant in which he requested that the defendant pay him Dhs500,000 plus a 12 per cent legal interest from the date of the lawsuit until full payment. He also requested that the defendant pay the incurred fees, expenses and lawyer’s fees.
The plaintiff pleaded that the defendant misled him into investing and asked him for a sum of money on the condition that he return the sum with profit.
On the strength of correspondence between them, the defendant procrastinated without justification, which prompted the victim to file this lawsuit with the aforementioned requests.
To support his lawsuit, the plaintiff attached photocopies of the WhatsApp conversations.
The court explained that it was proved by the submitted documents that the plaintiff filed his lawsuit with the aforementioned requests and attached social media conversations in support of his claim.
The defendant, on the other hand, failed to return the amount and did not raise any plea to prove that the plaintiff’s claim was false or he was innocent. Therefore, the court hereby finds that the defendant was indebted and is obligated to pay the claimed amount of Dhs500,000 to the plaintiff.
