Abu Dhabi Family, Civil, and Administrative Cases Court ordered a man to pay Dhs100,000 in compensation for verbally abusing, physically assaulting, and making indecent gestures toward a child.
In detail, the child’s father filed a lawsuit against the defendant, demanding Dhs100,000 in compensation for the harm caused to his son, along with the defendant bearing the legal fees and expenses.
The plaintiff stated that the defendant verbally abused, physically assaulted, and caused injuries to his minor son, in addition to making indecent gestures.
He added that the defendant was previously sentenced to one month of suspended imprisonment and a fine of Dhs10,000 and the ruling became final as it was not appealed.
The court clarified that Article 282 of the Civil Transactions Law obligates anyone who causes harm to another to compensate the injured party. The compensation amount is determined by the judge based on the case’s circumstances.
The court also emphasised that the victim is a minor child lacking the maturity to handle or cope with such insults, indicating that verbal abuse has a profound impact on the child’s psyche, reputation among peers, sense of dignity, and confidence, affecting their personality.
Given that the criminal ruling established the defendant’s guilt, the court awarded the plaintiff, as the child’s guardian, Dhs100,000 in moral compensation.
