The Abu Dhabi Family, Civil, and Administrative Cases Court ordered a man to return Dhs55,000 and pay an additional Dhs3,000 in compensation to another to whom he had sold a jet ski under false pretences.
The buyer discovered the jet ski had a malfunction and that the seller had tampered with the odometer to conceal its defects. The buyer filed a lawsuit seeking to rescind the sale contract, reclaim the Dhs55,000, the purchase price, and Dhs20,000 in compensation for damages, along with legal and attorney fees.
The plaintiff stated that the seller claimed the jet ski had only been used for 14 hours and was in good condition, but he noticed the jet ski overheating and took it to a workshop, where it was revealed that it had actually travelled 6,987 miles, far exceeding the claimed usage.
Additionally, the purchaser said that the seller had manipulated the jet ski’s computer system to alter the operating hours and that he attempted to resolve the issue amicably and recover the purchase price but was unsuccessful.
The court ruled that the seller’s fault was proved, ordering the rescission of the sale contract, the return of Dhs55,000 to the buyer, and Dhs3,000 in compensation for material and moral damage incurred.
