Abu Dhabi Family, Civil, and Administrative Claims Court has ordered a man to refund Dhs390,000 and Dhs50,000 in compensation to another man.
The defendant had advertised a vehicle for sale on a social media platform, claiming it was in good condition with no defects or malfunctions.
The plaintiff purchased and registered the vehicle but later experienced a breakdown and agency refused to repair it, citing a flood damage report on the car.
The plaintiff filed a lawsuit against the seller, requesting the annulment of the sales contract, a refund of Dhs390,000 with a 5% legal interest from the date of the claim until full payment, and Dhs100,000 in compensation for material and moral damages.
Additionally, the plaintiff sought to hold the seller responsible for legal fees and court expenses.
The plaintiff stated that the seller had advertised the vehicle on social media for Dhs390,000, claiming it was in excellent condition with no issues.
After purchasing the vehicle, it broke down, and the agency refused to repair it due to a flood damage report. The seller had the vehicle repaired outside the agency, voiding the warranty.
The court reviewed the evidence, including an expert report and a technical inspection of the vehicle. It was determined that the vehicle had indeed been flooded before the sale.
The inspection revealed moisture and water residue in the fuse box and rust in internal areas of the vehicle’s body.
The court concluded that the seller had acted negligently and attempted to deceive the buyer. As a result, the court ruled to annul the sales contract, order the refund of Dhs390,000, and Dhs50,000 in compensation to the plaintiff.
