However, due to the defendant’s financial inability to manage the company’s expenses, he repeatedly asked the plaintiff for financial support, which the plaintiff could not provide, so the defendant eventually decided to seek other employment, leading the plaintiff to falsely claim that the money was a loan, as evidenced by WhatsApp conversations and invoices.
The defendant’s lawyer requested the dismissal of the case, the plaintiff’s obligation to pay fees and expenses, and the administration of a decisive oath to the plaintiff to swear that the amount was a loan, that repayment was promised, and that it was unrelated to their partnership.
The court administered the decisive oath to the plaintiff in the specified form, who swore that he had lent the defendant Dhs30,650 in installments via bank transfers, which the defendant had promised to repay, and that the amount was unrelated to their partnership.
