Man ordered to pay woman Dhs30,000 in compensation for insulting and assaulting her in Abu Dhabi

The Abu Dhabi Family, Civil and Administrative Cases Court ruled that a man must pay a female individual compensation amounting to Dhs30,000 for moral and psychological damages, in addition to court fees and expenses. This ruling follows a conviction for insult, humiliation, abuse and assault against the female individual.

The case papers indicated that a woman had initiated legal proceedings against an individual on the grounds of insult, humiliation, abuse, and assault. She requested that the court obligate the defendant to pay her Dhs50,000 in compensation for material and moral damages, and to return her personal belongings, which were valued at Dhs40,000, on the grounds that the defendant had insulted, humiliated, abused, and assaulted her.

The aforementioned individual submitted a formal complaint to the Bani Yas Prosecution, and the Criminal Court for the External Regions subsequently issued a ruling. This ruling imposed an imprisonment sentence of one month for the offence of assault, and a further one month for the offence of threats. The execution of these sentences was suspended for a period of three years from the date of the ruling's finalisation. Additionally, a financial penalty amounting to Dhs10,000 was imposed for each charge, and the individual was obligated to pay the associated criminal fees. The ruling was upheld by the misdemeanor appeal of the Al Dhafra and External Regions Appeal Prosecution Office, and thus the ruling became final and binding with no appeal filed against the ruling. It has been demonstrated that the accused was found guilty of the charges of insult and assault that had been levelled against him in the aforementioned incident. Furthermore, he was found to be in possession of the plaintiff's belongings, which prompted the plaintiff to initiate legal proceedings. In her lawsuit, she submitted a copy of a medical report, which was attached to the lawsuit file.

The Court explained that the criminal court's judgment convicting the defendant had attained finality and binding status, and the judgment had acquired the force of res judicata with respect to its rulings prior to the civil court.

The elements of liability are not subject to re-examination. Consequently, the defendant's culpability was determined.

The court thus determines that the compensation for moral and ethical damages incurred by the plaintiff as a result of the defendant's error is sufficient, amounting to Dhs30,000.

 The court further noted that, in response to the woman's request to compel the defendant to relinquish the plaintiff's personal belongings, valued at Dhs40,000, she failed to substantiate the claim that the aforementioned personal belongings were in the defendant's possession. Consequently, the court has decided to refuse the request.
