The Ministry of Human Resources and Emiratisation (MOHRE) has confirmed that the terms of the job offer must be consistent with those of the labour contract.
It was highlighted that the application for a work permit is contingent upon the prior issuance of a job offer by the employer.
This is because the employer must first obtain approval from the Ministry for the job offer before submitting the work permit application.
The job offer must include specific details such as the nature of the contract, remuneration, number of weekly leave days, notice period, and any other stipulated conditions.
The Ministry has provided clarification that a worker may receive multiple job offers from different establishments, however, this is only permissible subsequent to the worker applying for a work permit from a single establishment.
And that other establishments are unable to apply for a work permit on behalf of the individual in question. Consequently, the system will respond by indicating that the worker has a work permit in effect.
The Ministry has stipulated the documentation required for the issuance of a new employment offer, which includes the following items: a copy of the passport valid for a period exceeding six months; the original electronic signature card for the owner or authorised signatory; a copy of the signature authorisation card displaying the establishment number in the Ministry of Human Resources and Emiratisation; salary details including the basic salary, allowances, conditions, and the nature of the contract; and a copy of the work permit cancellation less than 90 days in the case of a transfer permit.
According to the Ministry, the documents required to apply for work permits include the establishment's code with the Ministry of Human Resources and Emiratisation, a copy of valid commercial licence, and an original electronic signature card from one of the partners or owners authorised to sign.
The applicant's original ID card must also be submitted, along with the original vehicle statement if a driver quota is requested, or details of the required quota (profession, number, type) in the case of transport companies or car rental offices.
The water and electricity bill for the previous month must also be provided, along with a copy of a valid rental contract and proof of work volume. This can be demonstrated through project contracts, building licences, purchase and sale invoices, and so on.
