Abu Dhabi Commercial Court obligated a person who issued two dud cheques to another person during a commercial transactions worth Dhs100,000, to refund the amount and pay a delay interest of 5% annually from the date of filing the lawsuit until the full payment.

The details of the case date back to an earlier time when the a person filed a lawsuit against the suspect, in which he requested to obligate him to pay Dhs100,000, and a delay interest of 12% annually from the date of bouncing of the two cheques until full payment, besides Dhs10,000 in compensation for material and moral damages the appellant incurred.

The appellant explained that the appellee issued him two cheques of Dhs100,000 in commercial dealings between them, but when he went to cash them, they were bounced due to insufficient balance, and when he asked him to pay the amount, he refused.

The court clarified that the appellee was brought to the criminal court on charges of giving the appellant two dud cheques of Dhs100,000, which were bounced and he was convicted by a criminal ruling.

The court added that the appellee did not appear to clear himself of the value of the two cheques, and then it obligated him to pay the appellant the amount of the two cheques, besides a delay interest of 5% annually.
