Abu Dhabi court rejects husband's plea seeking Dhs30,000 from his ex-wife

The Abu Dhabi Family, Civil and Administrative Cases Court rejected a lawsuit filed by a man against his ex-wife, demanding that she pay him Dhs30,000, claiming that she had borrowed it from him during their marriage.

The appellant also demanded that she be obligated to pay the expenses and fees of the lawsuit and the lawyer's fees, explaining that during their marriage, he lent Dhs30,000, but after divorce, she did not return it.

Before the case management office, the appellant’s lawyer demanded that the appellee swear that she did not owe the appellant the amount.

The appellant attended the session and took the oath.

The court affirmed that it is not obligated to conduct an investigation which was not requested by the litigants, noting that taking the oath entails settling the dispute and that the case papers were void of any evidence to support the appellant's claim that he lent his ex-wife Dhs30,000.

The court added that it had proved that the appellee did not owe the complainant the amount, and so rejected the case and obligated the appellant to pay the costs and fees.
