UAE clarifies penalty of spiking food of another person with narcotic substances

The UAE Public Prosecution (PP), on Monday, clarified through a post published on its social media accounts the penalty for spiking food or drink of another person with a narcotic substance.

The UAE PP said that in accordance with the Article 50 of the Federal Decree-Law No.30 of 2021 for combating of narcotic and psychotropic substances, whoever spikes any of the narcotic or psychotropic substances stipulated in any of the schedules enclosed with this decree-law with the drink or food of others or makes another person consumes such substances without his/her knowledge of the truth thereof, shall be sentenced to imprisonment for a duration not exceeding five years and fined a monetary penalty not less than Dhs20,000.  

The UAE PP also said that the punishment would be imprisonment for a duration of not less than 10 years, if the acts stipulated in item 1 of this article are committed for the purpose of committing a crime against the victim or making him/her addicted to such narcotic or psychotropic substances.

“If such result is attained, this shall constitute a circumstance calling for the application of a heavier punishment. The punishment shall be life imprisonment or the death penalty, if the acts stipulated in item 1 of this article lead to the death of the victim,” the PP added.
