Woman obligated to pay Dhs429,000 inheritance money to her brother and sister in Abu Dhabi

The Abu Dhabi Family, Civil and Administrative Claims Court obligated a woman to pay Dhs185,000 to her brother and sister after they had filed a lawsuit against her, in which they stated that she withdrew their mother’s money a few days after her death.

According to the official documents, a man and his sister filed a lawsuit demanding that their sister pay them Dhs429,000: Dhs286,000 for her brother and Dhs143,000 for her sister, over and above the legal expenses and lawyer’s fees.

They indicated in their lawsuit that their mother opened a joint account with their sister 11 years before her death, provided that the account be managed by their sister because their mother was very old.

They explained that after their mother had died death of the mother, the account balance was found to be zero. They discovered that 5 days after their mother died, their sister withdrew Dhs400,000 from the account and later another Dhs31,000 before she closed the account. They attached to their lawsuit a copy of the inheritance distribution deed as well as copies of account statements and other documents.

The court delegated an expert to examine the documents of both parties and the statements sent by the bank in which the joint account was opened. The expert’s report concluded that the total sums withdrawn by the sister from her mother’s account amounted to Dhs431,000.

The Abu Dhabi Family, Civil and Administrative Claims Court ordered the sister (the defendant) to pay Dhs123,000 to her brother and Dhs61,600 to her sister but obligated the two parties to pay the legal expenses in equal halves.
