Court increases compensation for victim

The Abu Dhabi Appellate Court increase the amount of compensation for a woman from Dhs600,000 to one million dirhams. The victim had an accident which caused her permanent impairment of the brain, respiratory, and urinary system functions.

The victim reportedly filed a lawsuit demanding an insurance company and a vehicle driver pay her 2 million dirhams, besides the legal interest of 12%, as of the date of the incident until the completion of payment, in compensation for the material and moral damage she suffered.

She indicated that the driver of the insured vehicle with the insurance company caused her injury by mistake.  The Criminal Court ruled that the driver, the insurance company  and the victim were involved in causing the incident.

The forensic report affirmed that the woman suffers from cerebral symptoms that caused her a permanent disability and a deficit of brain function by 30%, an injury to the cervical vertebrae of 70%, a 5%  deficit in respiratory functions, and 50% permanent impairment of the functions of the urinary system.

The Court of First Instance ordered the insurance company and the driver to pay the woman Dhs600,000 along with the expenses.

The woman appealed the ruling and so did the insurance company that affirmed that the accident report proved that the victim was standing in the middle of the street on the second left lane after her vehicle broke down and did not take precautionary measures to warn those coming from behind.

The driver also appealed, demanding that the plaintiff’s requests be rejected for more than Dhs120,000.

The Appellate Court rejected the two appeals of the driver and the company and increased the amount of compensation to Dhs1 million.
